Who Can File: The Personal Representative of the Estate will file the lawsuit for the wrongful death claim on behalf of the Estate and the Wrongful Death Beneficiaries.  Following the death of a loved one, the Estate must be opened with the probate court and a Personal Representative appointed to administer the Estate.
