What If an Heir Cannot Be Located During Probate?
Probate can become more complicated when an heir cannot be found. The personal representative may know that someone is entitled to notice or a share of the estate but have no current address or reliable way to make contact.
The estate generally cannot proceed as though the heir does not exist. Additional searches, notices and court procedures may be required before property can be distributed.
Why Missing Heirs Can Delay Probate
The personal representative is responsible for identifying the people who may have an interest in the estate. This can include heirs under South Carolina law and beneficiaries named in a will.
When an heir cannot be located, the estate may not be able to complete required notices or final distributions. The person may have moved, changed names, lost contact with the family or passed away.
In other cases, the family may know very little about the person beyond a name or possible relationship to the deceased.
